Fill out and submit an official KHS 2011 Pet Photo
Calendar Contest entry form, and provide a digital color photo in horizontal layout either 9x12 or 8”x10” in size, a
compact disc with that single photograph saved to the highest resolution as a .jpg or a .tif file., a
brief description (75 words or less) of how your pet has improved your life and a $10 entry fee.
All entries, including the photograph and accompanying
compact disc with one copy of the photograph downloaded and digitally placed on
that compact disc shall become the property of KHS and will not be returned.
To be
accepted into the contest, you must provide all requested information.
Submitted images and written
descriptions must be the original creations of the entrant. Written
descriptions must be in English. KHS reserves the right to reject any
submission if it does not meet the eligibility requirements described later in
these Rules, or for any other reason at our sole discretion. If your entry is
rejected, it will be removed from the contest website and we will notify you
via email.

You must complete a separate entry form for every photograph you wish to enter.
All entrants must use the official 2011 KHS Pet Photo Calendar Contest entry
forms available at KHS Shelter,
All entries must be submitted by midnight, Pacific Standard Time, on Wednesday,
September 15, 2010. Voting for the Contest ends at midnight, Pacific Standard
Time, on Thursday, September 30, 2010.
Eligibility
The
Contest is subject to all applicable national, federal, and local laws and
regulations. KSH reserves the right to
change procedural rules regarding this contest to facilitate its fairness and
completion. Void where prohibited by
law. Contestants, who are 18-years-of-age and under on January 1, 2010, may
participate in the Contest with their parents' or guardian's assistance and permission. Employees, volunteers and family members of KHS
and its affiliates, are eligible.
Eligible Pets
Out
of concern for wild and non domesticated animals, the 2011 KHS Pet Photo
Contest is limited to the following species of pets: dog, cat, potbellied pig,
rabbit, horse, hamster, gerbil, guinea pig, ferret, mouse, rat, caged birds,
aquarium fish and domestic farm animals. Images that include any animal species
other than those listed above will be removed from the Contest and the entry
fee will be forfeited.
Eligible Images
Polaroid,
black and white photos or copyrighted professional photos cannot be accepted. All
photos must be depicted animals in a humane and dignified manner. Any image
that includes advertising, content that is deemed inappropriate, indecent,
obscene, as determined by the staff of KHS in their sole discretion, will be
removed from the Contest and the entry fee will be forfeited. We will only accept pictures that
have not been altered with editing software.
How the Voting Works
Contest
entrants can garner votes for their pet in an effort to win a spot in the 2011 KHS
calendar. After you submit your entry, you will be provided with a URL of your
pet's individual Contest page. To ask your friends and family members to vote,
you can pass this URL on to friends or use the "Tell-A-Friend" form
on the Contest website. KHS will also send you an email featuring your pet's
picture, with instructions on how to solicit votes. Votes are per photo and
cannot be combined or transferred. .
Because this is a KHS fund raising event,
people may vote as often as they want. Each vote must be accompanied by an
accepted donation via the KHS web site.
Those 11 photographs earning the
highest cash donations will be declared the 2011 Calendar winners.
To
vote, individuals must provide a valid email address. Any attempt to circumvent
this and other Contest rules is grounds for disqualification.
How the Winners are Determined
As
of midnight, Pacific Standard Time, Friday, October 1, 2010, KHS Staff will tally
the cash totals and determine those photographs that have the largest pledge
totals. Entrants are encouraged to select the best images and descriptions. It
is the opinion of KHS contest organizers, the voting/pledging public will be
judging entries on the quality of the image, the quality of the story
explaining how this pet improves the contestant's life, and how well the image
captures the life-enhancing qualities of the pet. Those finalists will be
announced via email to all Contest participants on or after Friday, October 15,
2010.
Entrant and Winner Notification
Entrants
are required to complete and sign an Affidavit of Eligibility and Liability
Release, which must be returned no later than close of business (4 p.m. PST) Friday,
October 8, 2010, or their entry and fees in the contest will be forfeited. If
any photograph is entered by an eligible person who is not of legal age in the
state of residence, that entry must include the name of the Winner's parent or
legal guardian, who must sign and return all required documentation. In the
event of noncompliance with these Rules, or if winning notification is
unclaimed or returned as undeliverable, that winning photograph’s place in the
calendar will be forfeited and may be awarded to an alternate winner.
Winning Placement in the KHS 2011 Pet Photo
Placement in the 2011 KHS Pet Photo
Calendar will be awarded to 11 winners. The entry with the most votes/donations
will be awarded the cover of the calendar. Month assignment of the remaining 11
finalists will be determined by KHS staff.
All 11 finalists will also
receive a complimentary copy of the calendar. Honorable mention photographic
winners may be used on the calendar pages as graphic highlights. KHS reserves
the right to name as many Honorable Mention winners as needed to graphically
enhance the final product.
Use of Email Addresses
Email
addresses entered by Contest participants will be used only for KHS communications.
Email addresses entered by voters will not be used for any purpose other than
as a means of verifying and finalizing the voter’s cash donation. KHS does not
sell, rent, trade, or share its email addresses with any third parties.
Tracking Your Pet's Progress in the Contest
Any
pet photo in the Contest can be located using the "Kootenai Humane Society
2011 Pet Photo Calendar Contest" link found on the KHS web site (www.kootenaihumanesociety.com).
The number of votes (dollars raised) by the pet photo will appear by the image
of the pet.
Use of Images
Warranties. When you enter the "Kootenai Humane Society 2011 Pet Photo
Calendar Contest" you warrant that the photograph is original, that you
are the sole owner and copyright holder of that photograph, and that you have
not granted exclusive rights of that photograph to any other person or entity. All
photos entered into the contest can not have been entered into any other
organizations photo contest where you have lost the rights of ownership to the
picture. You also warrant that the photograph does not invade the right of
privacy of any individual; does not infringe any trademark, trade name, trade
secret, intellectual property right, or other common law or statutory right;
nor does it contain any material that otherwise violates any criminal
prohibition or the personal or proprietary rights of any person or entity. .
Grant of Rights in Connection with the Contest. By
entering the Contest, you agree to grant to KHS, its legal representatives,
successors, and assigns, the nonexclusive right and permission to use, modify,
adapt, reproduce, publish, and distribute the photograph, or any portion
thereof, throughout the world, in any printed form and by any kind of
mechanical or electronic or any other method or device of reproduction,
publication, and distribution known or later developed, during the full term of
the copyright, and without notification or payment, in connection with the "Kootenai
Humane Society 2011 Pet Photo Calendar Contest". KHS agrees to attribute
authorship and copyright ownership to you when it publishes and distributes the
photograph you submitted. KHS also agrees that it will never sell the
photograph or rights in the photograph to any individual or entity.
Grant of Rights for Additional Purposes. By entering
the "Kootenai Humane Society 2011 Pet Photo Calendar Contest", you
also agree to grant to KHS, its legal representatives, successors, and assigns,
the nonexclusive right and permission to use, modify, adapt, reproduce,
publish, and distribute the photograph, or any portion thereof, throughout the
world, in any printed form and by any kind of mechanical or electronic or any
other method or device of reproduction, publication, and distribution known or
later developed, during the full term of the copyright, and without notification
or payment. KHS agrees to attribute authorship and copyright ownership to you
when it publishes and distributes the photograph you submitted. KHS also agrees
that it will never sell the photograph or rights in the photograph to any
individual or entity.
Use of Descriptions
When
you enter the "Kootenai Humane Society 2011 Pet Photo Calendar
Contest" you warrant that the description of how your pet improves your
life is original, that you are the sole author and copyright holder of the
description, and that you have not granted exclusive rights in that description
to any other person or entity. You also warrant that the description contains
no defamatory material or injurious instructions; does not invade the right of
privacy of any individual; does not infringe any trademark, trade name, trade
secret, intellectual property right, or other common law or statutory right;
nor does it contain any material that otherwise violates any criminal
prohibition or the personal or proprietary rights of any person or entity.

You also agree to grant to KHS, its legal representatives, successors, and
assigns, the nonexclusive right and permission to use, reproduce, modify,
adapt, publish, and distribute the description, or any portion thereof,
throughout the world, in any printed form and by any kind of mechanical or
electronic or any other method or device of reproduction, publication, and
distribution known or later developed, during the full term of the copyright,
and without notification or payment, as part of and in connection with the "Kootenai
Humane Society 2011 Pet Photo Calendar Contest". KHS will not use your
description for any purposes not connected with the "Kootenai Humane
Society 2011 Pet Photo Calendar Contest". KHS will never sell the
description or rights in the description to any individual or entity. KHS
agrees to attribute authorship and copyright ownership to you when it publishes
and distributes the description you submitted.
Additional Terms
By
accepting a prize (placement in the "Kootenai Humane Society 2011 Pet
Photo Calendar"), the Winner consents to KHS's use of his or her name,
likeness, voice, and/or biographical information for promotional and other
purposes without additional compensation, except where prohibited by law. The
Winner, by acceptance of any prize, acknowledges compliance with these Rules
and agrees to release KHS its affiliates, and its officers, directors,
employees, independent contractors, representatives, and agents from and
against any claim or cause of action arising out of participation in the
Contest or the receipt, redemption, or use of any prize, including any injuries
or damages of any kind sustained in connection with the use, acceptance,
possession, or awarding of any prize.
Limitation of Liability
Releases
are not responsible for printing, typographical, human or other errors of any
kind in any Contest-related materials or for stolen, lost, late, misdirected,
damaged, incomplete, or illegible entries. If, for any reason, the Contest is
not capable of running as planned, or infection by computer viruses, bugs, or
tampering, unauthorized intervention, fraud, actions of entrants, technical
failures, or any other causes corrupt or infect the administration, security,
fairness, integrity, or proper conduct of the Contest, KHS reserves the right
at its sole discretion to disqualify any entry or entrant and/or to cancel,
terminate, modify, or suspend the Contest and at its sole discretion award a
prize from among all eligible non-suspect entries validly received prior to the
action requiring such modification. By entering, all Contestants agree that the
